1. Voluntary Participation & Assumption of Risk

I understand that indoor cycling classes at Sessions Cycle (the “Studio”) involve vigorous physical activity, including but not limited to high-intensity cardiovascular exercise, strength movements, stretching, and use of stationary bicycles and related equipment.

I acknowledge that participation involves inherent risks, including but not limited to:

  • Overexertion, fainting, dizziness, or shortness of breath
  • Heart strain, cardiac events, or other serious medical issues
  • Muscle strains, sprains, or tears
  • Joint injuries and back injuries
  • Slips, falls, or collisions with equipment or other participants
  • Equipment malfunction or failure
  • Exposure to communicable diseases (including viruses and bacteria)

I understand these risks cannot be fully eliminated, even with reasonable care.
I voluntarily choose to participate and assume all risks of injury, illness, or property damage.

2. Health & Medical Condition

I represent that:

  • I am in good physical condition and able to participate in strenuous exercise.
  • I have consulted a physician regarding my participation or have voluntarily chosen not to do so.
  • I will immediately stop exercising and notify an instructor if I feel unwell.

I understand the Studio’s staff are not medical professionals and cannot diagnose or treat medical conditions.

3. Release of Liability & Waiver of Claims

To the fullest extent permitted by law, I hereby waive, release, and discharge:

Sessions Cycle, its owners, instructors, employees, contractors, agents, landlords, affiliates, and representatives (collectively, the “Released Parties”)

from any and all claims, demands, actions, causes of action, damages, or liabilities, whether known or unknown, arising out of or relating to my participation in Studio activities or use of the Studio’s facilities, equipment, showers, or premises.

This waiver includes claims arising from the ordinary negligence of the Released Parties.
This waiver does not apply to claims that cannot be waived under California law (e.g., gross negligence or willful misconduct).

4. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorneys’ fees) arising from:

  • My participation in Studio activities,
  • My violation of Studio rules, or
  • My negligent or intentional actions that cause harm to others.

5. Personal Property

I understand the Studio is not responsible for theft, loss, or damage to my personal property, whether stored in lockers, cubbies, or elsewhere on the premises.

6. Emergency Medical Treatment

In an emergency, I authorize Sessions Cycle staff to obtain emergency medical care for me, including calling 911.
I agree to be financially responsible for any medical treatment or transportation provided.

7. Studio Policies

I agree to follow all Studio rules and guidance, including:

  • Arriving early enough for bike setup and safety checks
  • Informing instructors of any injuries, limitations, or pregnancy
  • Using equipment responsibly and only as instructed
  • Following posted rules regarding showers, changing rooms, and shared spaces

The Studio may refuse service or end participation for unsafe or inappropriate behavior.

8. Governing Law & Venue

This Agreement is governed by the laws of the State of California.
Any disputes arising out of or relating to this Agreement or my participation shall be resolved exclusively in the state courts located in Los Angeles County, California.
I consent to the jurisdiction of these courts.

9. Severability

If any portion of this Agreement is found to be invalid or unenforceable, the remainder shall continue in full force and effect.

10. Acknowledgment & Electronic Signature

I acknowledge that I have read this Agreement carefully, understand its contents, and understand that I am giving up substantial legal rights.
I sign this Agreement voluntarily and intend my signature to be a complete and unconditional release of liability to the fullest extent permitted by law.
